It seems to me it would be tough to get any kind of enforcement because there are hundreds of clogged culverts all over the place...

Depending upon how valuable to you it is not to be at war with your neighbors, you could always file a small claims case against them for the damage to your property that resulted from their failure to maintain their culvert. If you don't win, you're out the nominal fee to file the case. If you do win, then your neighbor can fight with their insurance company over whose pocket the money to pay the judgement is coming out of and you get your driveway repaired at the expense of someone else and any hope of having a decent relationship with your neighbor.

I might be incorrect about what the definition of culverts. We have a drain ditch that runs along the road and under our driveway. In our instance, our own drain was clogged, probably 80%, so water was allowed to flow through, but not a heavy amount. We called Jefferson county and they came out and unclogged it. And, did the neighbors as well. So, if live in Jeffco and I'm understanding what a culvert is, you can try that route.

Jeffco road and bridge were in our 'hood last week clearing culverts. You can call Road and Bridge and find out or let them know where you are seeing clogged culverts. If you are in Jeffco, you can find your district here at bottom of page

After replacing our culvert twice (we are in Park County) only to have the road grater fill it and damage the ends we gave up. This was back when things were much less expensive and there is no recourse you can take in Park County.
When we were in Jeffco also on a dirt road no issues the county cleaned what the graters put in. I know I am not your neighbor and sorry for what you are going through but who knows maybe they are in the same boat as we are. |

I know the culvert is not on your own property but why don't you just clean it out to save your driveway?
And if the neighbor takes exception to you being on his property, tell him you've been told you can take him to small claims court and possibly get him to pay for fixing your driveway but, being neighborly, you thought it would be better for all if you just cleaned the culvert out yourself. |

Tiller if it is like ours it is packed full and well your only option is for someone to come pull it out drag it around clean the spot with a scoop (assuming when they pull it the pipe does not break) then put it back in place and fill in over the top.
As I said we gave up and we have been here 19 years at this house 10 in Jeffco before here and dealt with all of this for the first 7 years replacing at a cost of over $300.00 for a new pipe, cleaning/digging. If Park County grades the road during the winter no chance of cleaning stuff away been there and tried that. Spring and summer we did the best we could but no way to get water to the bottom of the driveway to help soften as you need many gallons not just a bucket. It would probably be easier to build a berm to redirect the water which is much of what we did so it flows away from our area to a point that is much deeper along the road. |

I'm in Park County and have argued with Road and Bridge for 38 years about my culvert. They will tell you that the culvert is the responsibility of the homeowner. But the ditches are the responsibility of the county. I'm at the bottom of a steep hill, all the gravel ends up in the ditch in front of my house. It's a simple fact that the gravel has to be taken out of the ditch below my culvert to make space for the additional gravel to go. They've cleaned out that ditch (not just put a furrow in it with the grader) maybe two or possibly three times in 38 years. I even paid someone privately to do it a few times. I gave up. It's a losing battle and every new R&B manager has a different (sometimes harebrained) idea about how to solve the problem if they pay attention to it at all. Usually it's not at all.
